Most Common Causes - Of course, the term ‘head-on collision’ describes any road accident where two drivers make contact whilst driving towards each other. Whether the two cars impact middle to middle or perhaps one just catches the front of another, they can be devastating especially when speed is involved because the two cars are travelling in the opposite direction to one another.

Dangers of Head-On Collisions - Compared to all other types of incidents, head-on collisions are by far the most dangerous and lead to the most amount of fatalities. Typically, most other accidents push the car in the direction it’s already travelling so whiplash is common along with bruised kneecaps and perhaps concussion. With head-on collisions, the car is instantly stopped in its tracks because the impact comes from the front (the opposite direction).

Unfortunately, we have seen fatalities in many of our cases but head-on collisions also cause lacerations, contusions, neck and brain traumas, traumatic brain injuries, broken bones, internal injuries, and whiplash. These are all painful in the short-term, but they can also lead to a life of pain and physiotherapy.

Insurance Protection - Since Florida has certain no-fault insurance laws in place, all drivers on the road must have personal injury protection (PIP) benefits to the value of $10,000. Regardless of who is to blame, this amount will provide coverage for you and all passengers.

With PIP in place, you can cover 60% of lost wages and earning capacity moving forward, 80% of medical expenses that arise as a result of the accident, and various household costs required due to the incident. If the victim were to pass away in the accident or any time after as a direct result of the collision, the family is entitled to half this amount in death benefits.

Is $10,000 Enough for PIP Coverage? - If your injuries are more severe and you spend over the $10,000 allowance, you can then proceed by suing the guilty party if you can prove they are to blame for the incident. Unless you have a permanent injury from the collision, recovery will be for all economic damages; permanent injury includes significant or permanent scarring, loss of bodily function, and disfigurement. Finally, death will be slightly different but family members can recover costs here too.

Filing a Lawsuit - With head-on collisions, the key pieces of information when forming a case is whether or not you can prove your expenses and that the other driver was at fault. When suing, you’re essentially stating you have a permanent injury and that you have exceeded the $10,000 allowance so these need to be proven. As mentioned, you also need to prove the fault of the other driver or else they won’t owe you a single cent. Gathering Evidence - In terms of gathering evidence, you need every little detail that will help to prove the four elements listed above. For example, the most useful pieces of evidence come from photographs of the scene, police reports, medical records, videos, medical bills, and eyewitnesses if you were able to either take a statement or take contact information from those who had seen the accident.

After this, you could also look towards pay packets to show your drop in income, a journal noting your pain and experience on a day-to-day basis, and an expert testimony who discusses your injuries and how you’ll be affected in the coming weeks, months, and years.
